Terms of Service

The following terms and conditions (the "Terms") govern the products and services (the "Products") offered through BloodPressureHeartMeds.com to you (the "Customer"). By placing an order for Products, Customer agrees to be bound by and accepts these Terms as well as the Customer Agreement.

 

Other Documents

These Terms may not be altered, supplemented, or amended by the use of a Customer purchase order or similar Customer document. Any attempt by Customer to alter, supplement or amend this document or to enter into an order for Products that are subject to additional or altered terms and conditions will be null and void, unless otherwise agreed to in a written agreement signed by both Customer and BloodPressureHeartMeds.com. BloodPressureHeartMeds.com may change the Terms at any time without prior notice.

 

Governing Law

These Terms will be governed by and construed in accordance with the laws of the jurisdiction from which Products are shipped to Customer (unless BloodPressureHeartMeds.com elects otherwise in its sole discretion), without giving effect to any principles of conflicts of laws. All disputes, controversies or claims arising out of or in connection with these Terms shall be submitted to and subject to the jurisdiction of the courts in the jurisdiction from which Products are shipped to Customer (unless BloodPressureHeartMeds.com elects otherwise in its sole discretion). The parties submit and attorn to the exclusive jurisdiction of said courts to finally adjudicate or determine any suit, action or proceeding arising out of or in connection with these Terms.

 

Privacy Policy

By submitting an order for products and services from BloodPressureHeartMeds.com, the Customer consents to the collection and use of personal information as described in our privacy policy published on the BloodPressureHeartMeds.com website. BloodPressureHeartMeds.com reserves the right to amend its privacy policy from time to time by posting the updated policy on its website. Customer agrees to review the privacy policy each time Customer submits an order for products or services.

 

Orders; Prices; Payment Terms; Interest

Orders are not binding upon BloodPressureHeartMeds.com until accepted by BloodPressureHeartMeds.com in writing, which shall not occur until after all items in the order have been shipped. The prices for the Products shall be as set forth in BloodPressureHeartMeds.com's website at the time of acceptance of an order by BloodPressureHeartMeds.com. Prices for Products shall be subject to change without any further notice. Credit terms are within BloodPressureHeartMeds.com's sole discretion, and unless otherwise specified in BloodPressureHeartMeds.com's invoice, payment must be received by BloodPressureHeartMeds.com prior to BloodPressureHeartMeds.com's acceptance of an order. Payment for the Products will be made by a personal check. The Customer will be charged $25 USD for electronic or physical checks that are returned as NSF. If credit terms have been agreed to by BloodPressureHeartMeds.com, invoices are due and payable within thirty days of the date of the invoice. Customer agrees to pay interest on all amounts past due at a rate of 20 per cent per annum.

 

Termination

BloodPressureHeartMeds.com may terminate these Terms and any Customer's account, if in BloodPressureHeartMeds.com's sole discretion, Customer violates any of these Terms, fails to respond to any inquiries by BloodPressureHeartMeds.com within a reasonable time period, engages in fraudulent or illegal activities, or BloodPressureHeartMeds.com is unable to verify or authenticate any information Customer provides to BloodPressureHeartMeds.com. Upon termination, Customer will immediately stop using the Products, will remove any software provided by BloodPressureHeartMeds.com from its computer(s) and will destroy all copies of such software and all other information or data provided by BloodPressureHeartMeds.com or otherwise obtained by Customer in connection with the Products.

 

Notices

All notices to be provided by BloodPressureHeartMeds.com to Customer under these Terms may be delivered in writing by courier, by email, or by mail to the address provided by Customer in its order, and will be effective upon receipt.

 

Assignment

Customer may not assign these Terms or any of its rights or obligations under these Terms, without the prior written consent of BloodPressureHeartMeds.com. Any purported assignment without such consent will be null and void. BloodPressureHeartMeds.com may assign these Terms and its rights and obligations under these Terms without the consent of Customer. Waiver. The failure of BloodPressureHeartMeds.com to enforce any provision hereof shall not constitute or be construed as a waiver of such provision or of the right to enforce it at a later time. Survival. All obligations of the parties under these Terms which by their nature would continue beyond the termination, cancellation or expiration of these Terms including without limitation obligations relating to warranties, indemnification, confidentiality, limitation of liability, and jurisdictional matters shall survive any termination, cancellation or expiration of these Terms.

 

Customer Agreement

In addition to these Terms, the Customer Agreement applies to all Customers using BloodPressureHeartMeds.com's Products. The Customer Agreement can be found on the BloodPressureHeartMeds.com web site and is incorporated herein by reference.
